POPIA Notice
This notice is given under the Protection of Personal Information Act, 2013 ("POPIA"). It explains what personal information MediaMotion processes, why, and how South African data subjects can exercise their rights.
1. Responsible party
Datacline Ltd, with processing hubs in South Africa, is the responsible party for the processing described in this notice. Our Information Officer can be reached at privacy@mediamotion.ai for any request relating to personal information.
2. Who this notice is about
POPIA requires us to be specific about whose information we process. Three groups are relevant to our business, and this notice covers all three:
- Content data subjects — presenters, performers, callers and guests whose voices or likenesses appear in broadcast, radio or podcast content we license from media-network partners
- Partner contacts — individuals who represent a data-provider or model-builder organisation in dealings with us
- Website visitors — anyone who submits a contact form on this site
3. What we process, and how we get it
For content data subjects, we do not collect information directly — we receive already-recorded broadcast, radio and podcast content from data-provider partners under a licensing agreement. This can include:
- Voice recordings and, for video, likeness
- Speech content, which may incidentally include opinions, or references to health, beliefs or other special personal information as defined by POPIA, where a speaker raises these on-air
- In phone-in and call-in formats, names, phone numbers or other identifying details volunteered by callers
For partner contacts and website visitors, we collect the contact and business details described in our Privacy Policy, provided directly by you.
4. Special personal information
POPIA treats certain categories — including race or ethnic origin, health, religious or philosophical beliefs, and criminal behaviour — as special personal information requiring additional justification. Because we license real broadcast conversation rather than curated statements, this category of information can appear incidentally in the content we process (for example, a caller discussing a health condition on a talk-radio segment).
We process this only to the extent it is embedded in lawfully licensed broadcast content, we do not seek it out or categorise individuals by it, and our redaction process removes directly identifying details — names, phone numbers, addresses — from phone-in and call-in material before delivery to any buyer.
5. Our lawful basis for processing
- Content data — our data-provider partners represent and warrant, under the licensing agreement, that the content was lawfully recorded and that they hold the rights needed to licence it for AI-training use. We rely on that contractual chain, combined with our own rights-review at the audit stage, and honour any opt-out request directly from a presenter or performer regardless of the underlying licence
- Partner contacts — processing is necessary to perform or negotiate a contract with the organisation you represent
- Website visitors — processing is based on your consent when you submit a contact form
6. Purpose of processing
Content data is processed to make it usable for AI model training: language identification, speaker diarisation, transcription, translation, word-level alignment, and redaction of personally identifying information from phone-in material. It is then delivered under licence to model builders for training use only — never for re-identification, profiling, or any purpose unrelated to model development.
7. Cross-border transfers
Licensed buyers may be located outside South Africa. Where personal information embedded in content leaves South Africa as part of a licensed data set, we require the recipient to be bound by licence terms restricting use to training purposes and prohibiting redistribution — providing a level of protection consistent with POPIA's cross-border transfer requirements.
8. Retention
Content data is retained for the term of the relevant licensing agreement and any downstream licences already granted at the time a provider relationship ends. Partner-contact and website-visitor information is retained only as long as needed to manage the relationship and meet legal obligations.
9. Your rights under POPIA
If you are a South African data subject, you have the right to:
- Be notified that your personal information is being collected or has been accessed by an unauthorised party
- Request access to the personal information we hold about you
- Request correction or deletion of inaccurate, irrelevant, excessive or unlawfully obtained personal information
- Object to processing of your personal information on reasonable grounds
- Withdraw consent where processing is based on consent
- Lodge a complaint with the Information Regulator of South Africa
To exercise any of these rights, write to privacy@mediamotion.ai. If you are a presenter, performer or caller who wants a specific title, series or clip excluded from processing, tell us which one and we will action the request and confirm in writing — this is honoured independently of what any underlying licence permits.
10. Complaints to the Information Regulator
If you believe we have not handled your personal information in line with POPIA, you may lodge a complaint with the Information Regulator of South Africa, whose contact details are published at inforegulator.org.za. We would appreciate the chance to resolve any concern directly first, at privacy@mediamotion.ai.
